The Mental Capacity Act 2005 is designed to protect the rights of any individual who is unable to make decisions for themselves.
This can include individuals with severe and enduring mental health issues, through to those with dementia and other conditions that affect the mind.
The legislation is designed to prevent family members or third parties from making decisions on the individual’s behalf that don’t necessarily reflect their best interests or their personal goals.
This online course will give you the understanding you need to understand the need for capacity assessments and how to legally act on behalf of someone who is deemed not to have capacity.

Whether you’re a family member, carer or social care worker responsible for an individual who lacks capacity, this course will give you the information you need.
Due to the legalities surrounding capacity, advocacy, power of attorney etc, knowing the legal rights of the individual and your role is essential.
This online course will give you a comprehensive understanding of the Mental Capacity Act 2005. This will allow you to act in accordance with the law on behalf of a third party.

Unit 1: Awareness of the Mental Capacity Act 2005
Upon completion of this unit you will:
- Understand the importance of the Mental Capacity Act 2005
- Understand the key elements of the Mental Capacity Act 2005
- Understand ‘restraint’ as defined in the s6(4) Mental Capacity Act 2005
- Understand the importance of complying with the Mental Capacity Act 2005 Code of Practice when working with individuals who lack capacity
Entry Requirements
There are no specific entry requirements however learners should have a minimum of level two in literacy and numeracy or equivalent.
The qualification is suitable for learners of 16 years of age and above.
This qualification is designed for a range of learners in a health and social care setting including those in a work role and informal/family carers.
The objectives of this qualification are to help learners to prepare for further training and to support a role in the workplace where the individual may work or interact with vulnerable adults.
All course fees, inclusive of all payment plans including our Premium Credit Limited option, must be settled before certification can be ordered.
*You will have access to the course for 24 months.
Students must submit a portfolio of work that evidences the achievement of all learning outcomes associated with the course content.
This must be submitted to your dedicated tutor via the online learning portal and assessed. Once the tutor is satisfied you have met all your learning outcomes you will pass the course.
*You will have access to the course for 12 months only.
